Subscription Services Agreement

“Built by Zendesk Marketplace Applications” refers to integrations and applications created or developed by Zendesk or its related companies and made available in the Zendesk Marketplace (available at and which are governed by this Contract, unless Zendesk provides you with another agreement at the time of your availability or access to integration or application. “service plan (s) “, packaged service plans (s) and associated functions and services (such as on the service website) for services. 3.1 Duration. (a) “customer support,” the NiceLabel business team that provides services that help the customer solve problems related to subscription services. (d) Clarabridge does not offer any guarantees or assistance under this Agreement and the Customer accepts that Clarabridge is not responsible for non-Clarabridge`s products or services, including, but not only, third-party websites, customer content and/or third-party content. “Additional features” refers to additional functions or functions (including, but not limited, created by Zendesk Marketplace apps, Zendesk Labs, fast access programs or beta services) that are available or enabled via the service but are not part of the service. Other functions include third-party services purchased and/or subscribers via an order form, which are resold by Zendesk and are governed by the third party`s alternative agreement. Additional features are acquired or enabled separately and unambiguously from your service plan and related services provided. 1.2 Activation of services. After the order form is executed, Smarsh initiates the service activation by giving the customer access to an account within the respective service (“Activation Date”).

The customer is responsible (a) for providing Smarsh with all historical data to be archived in a format acceptable to Smarsh; and (b) set up customer messaging services or other customer data transmission systems (as defined in Section 3.4) in Smarsh. 10.1 If you sign up for a free trial version for one of the services, we will provide you with these services free of charge in a trial version until (a) the end of the free trial period for which you have registered to use the corresponding services is made available free of charge; (b) the start date of subscription to such a service that you purchased for these services; or (c) terminate the proceedings by us alone. Test conditions may appear at the test registration site. These additional conditions are incorporated into this agreement by reference and are legally binding. Please read the appropriate documentation during the trial period to familiarize yourself with the functions and functionality of the services in the corresponding service plans before making your purchase. EACH SERVICE ENTERS YOU INTO A SERVICE, AND ANY CONFIGURATIONS OR CUSTOMIZATIONS MADE TO A SERVICE BY OR FOR YOU, DURING YOUR FREE TRIAL WILL BE PERMANENTLY LOST UNLESS YOU PURCHASE A SUBSCRIPTION TO THE SAME SERVICE AS COVERED BY THE TRIAL, PURCHASE THE APPLICABLE SERVICE, OR EXPORT SUCH SERVICE DATA, BEFORE THE END OF THE TRIAL PERIOD.
